HC rejects Dileep’s plea

Kochi: The Kerala High Court has rejected actor Dileep’s appeal challenging a single judge order directing the Ernakulam District and Sessions Judge to furnish copies of witness statements to the survivor in the actor assault case, media reports said.

A division bench observed that there are no reasons to review the single bench order.

Dileep’s counsel argued that the survivor cannot file interim applications in a case that was finalised on December 7, 2023 and cited Supreme Court judgments.

The survivor’s counsel argued that the inquiry was initiated due to violations of the survivor’s fundamental rights due to unauthorised access of a memory card containing objectionable visuals of the assault of the survuvor on February 17, 2017.

The survivor’s  counsel argued that the accused had no basis to object to the High Court single bench order directing the probe into unauthorised access of the memory card.

The enquiry had found that the memory card kept under the safe custody of the court was illegally accessed by a magistrate, a private assistant of the district judge and a Shiresthdar.

The actor was abducted and abused on February 17, 2017, and Dileep was jailed in this conbection.

Dileep, who is eighth accused, came out after getting a bail after spending about three months in jail, the reports said.
