Court asks wife to pay maintenance

Kochi: In a major verdict, the Bombay High Court has directed a woman to pay monthly maintenance to her unemployed husband, media reports said.

Upholdìng the judgment of a lower court in Kalyan, the High Court rejected her petition challenging the lower court’s order which directed her to pay Rs 10,000.

The verdict was based on Section 24 of the Hindu Marriage Act which describes “spouse,” as husbands and wives with either party having right to seek maintenance during marital dispute proceedings if they are unable to sustain themselves.

The order of the lower court in Kalyan came on March 13, 2020.

The petitioner argued in the High Court about her inability to pay the maintenance citing overheads like home loan repayment, upbringing of a minor child, and her resignation from job.

When asked to disclose her source of income, she was not able to do it, the reports said.
